These Gift Card Terms and Conditions (“Gift Card Terms”) apply to digital gift cards (“Gift Cards”) issued by Sketchy Group, LLC (“Sketchy,” “we,” “us,” or “our”) and sold on sketchy.com (the “Site”). By purchasing or redeeming a Gift Card, you agree to these Gift Card Terms and to Sketchy’s Terms of Service and Privacy Policy, which are incorporated by reference. These Gift Card Terms are presented at the point of purchase and are always available on the Site.
If any state or local law that applies to your purchase or use of a Gift Card is more favorable to you than these Gift Card Terms, that law governs to the extent it applies. Nothing in these Gift Card Terms limits any right you have under applicable law that cannot be waived.
A Gift Card is a digital code loaded with a U.S. dollar value that can be applied as credit toward the purchase of Sketchy subscription plans on the Site.
Gift Cards may be purchased on the Site with any payment method we accept and are delivered by email to the recipient designated by the purchaser (or to the purchaser). You must be at least 18 years old (or the age of majority where you live) to purchase a Gift Card. Gift Cards are issued in U.S. dollars and are redeemable only by recipients in the United States.
If a Gift Card email does not arrive, contact us at support@sketchy.com — we will resend it to the original designated recipient at no charge.
To redeem a Gift Card, the recipient enters the Gift Card code on the Site while signed in to a Sketchy account (creating an account is free). Upon redemption, the full Gift Card value is added to the account as Sketchy credit.
Gift Cards and Sketchy credit are not redeemable or refundable for cash, except where required by law. Where state law grants you a cash-redemption right, we will honor it. For example, California residents may redeem any Gift Card or credit balance of less than $15.00 for cash (Cal. Civ. Code § 1749.5). Residents of other states with small-balance cash-redemption laws (including Washington, Massachusetts, Rhode Island, Maine, Colorado, Montana, Oregon, and Vermont) may request cash redemption of qualifying balances by contacting support@sketchy.com.
Risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission of the Gift Card to the designated recipient. Sketchy is not responsible for Gift Cards that are lost, stolen, deleted, or used without permission. However, if a Gift Card code has not yet been redeemed, contact us with proof of purchase and we will make reasonable efforts to cancel the original code and issue a replacement for the unredeemed value at no charge.
Except where required by law, Gift Cards may not be returned or canceled after delivery to the recipient, and Gift Card purchases are not refundable to the purchaser. This section does not limit any cash-redemption right described in Section 6 or any non-waivable right you have under applicable law.
Gift Cards and Sketchy credit may not be: (a) used to purchase other Gift Cards; (b) resold, brokered, or transferred for value; (c) reloaded; or (d) used for any purpose other than purchasing Sketchy subscription plans on the Site. Gift Cards obtained through unauthorized resale may be dishonored.
We may refuse to issue, decline to honor, or cancel a Gift Card, and may suspend associated credit, where we reasonably suspect the Gift Card was obtained or used fraudulently or in violation of these Gift Card Terms. Where we cancel a Gift Card under this section, we will refund the verified original purchaser any unredeemed value unless prohibited by law or the purchase itself was fraudulent.
We may update these Gift Card Terms from time to time by posting the updated version on the Site. Changes will not materially reduce the value, or limit the redemption rights, of any Gift Card purchased before the change took effect.
From time to time we may issue promotional codes or credits for free (for example, as part of a marketing campaign). Promotional codes are not Gift Cards, are not purchased or loaded with funds, and may carry expiration dates and other conditions disclosed at the time of issuance. These Gift Card Terms apply to promotional codes only where we say so.
EXCEPT AS EXPRESSLY PROVIDED IN THESE GIFT CARD TERMS, SKETCHY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, IS THE REPLACEMENT OF THAT GIFT CARD OR ITS UNREDEEMED VALUE. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
If any provision of these Gift Card Terms is found invalid, illegal, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions will continue in full force.
These Gift Card Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except as provided in Section 2. Any dispute arising from Gift Cards is subject to the dispute-resolution provisions of Sketchy’s Terms of Service.
